Terms and Conditions
§ 1 Scope and provider
These terms apply to the purchase and use of the software “IPX” via this website. Provider and contracting party is HMF-IT UG (haftungsbeschränkt), Parkstr. 31, 49080 Osnabrück, Germany (hereinafter “we”). They apply to consumers and businesses. Deviating terms of the buyer do not apply, even if we do not expressly object to them.
§ 2 Conclusion of contract
The presentation of the editions on this website is not a binding offer but an invitation to order. On the “Buy” page you choose an edition, confirm these terms, the licence terms and immediate delivery, and click the PayPal button “Buy now”. By approving the payment at PayPal you submit a binding offer. The contract is concluded when we capture the payment and display the licence key to you or send it by e-mail.
The contract language is German. We store the contract text (order data and these terms in the version valid at the time). You receive the order data with the order confirmation by e-mail.
§ 3 Prices and payment
All prices are final prices in euros and include statutory VAT. There are no shipping costs. Payment is made via PayPal; depending on PayPal's offer also by direct debit or credit card. PayPal's terms of use apply in addition. We send you the invoice by e-mail after the purchase.
§ 4 Delivery
Delivery is digital: you receive the licence key immediately after payment on the order page and by e-mail, the software via the download page. Activation requires a one-time internet connection.
§ 5 Right of withdrawal
Consumers have a right of withdrawal in accordance with the withdrawal policy. For digital content it expires if you have expressly consented to us beginning delivery before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal.
§ 6 Rights of use
Scope and limits of use (number of PCs per edition, updates, trial, basic tools) are governed by our licence terms. They apply in addition to these terms.
§ 7 Trial and basic tools
IPX can be downloaded free of charge before purchase and tried for 30 days with all tools. Afterwards the tools marked “Basic” remain free to use. There is no entitlement to the provision or further development of the trial version and the basic tools.
§ 8 Responsible use
IPX contains tools that query systems on the network (for example port check, LAN scan, traceroute). You undertake to use them only on systems you are responsible for or whose operator has consented, and to comply with applicable laws and the terms of use of the queried services (such as WHOIS and blacklist operators). You alone are responsible for the consequences of any misuse.
§ 9 Updates and support
Buyers receive updates to the extent of the licence terms. We provide support by e-mail at support@hmf-it.de within a reasonable time, usually on working days.
§ 10 Warranty
The statutory provisions on digital products (§§ 327 et seq. BGB) apply. Results of the tools are based on the answers of third-party systems (DNS, WHOIS, websites, mail servers) and may be incomplete or outdated; they do not replace your own verification. For businesses the limitation period for defect claims is one year.
§ 11 Liability
We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise liability for slight negligence is excluded. Liability under the Product Liability Act remains unaffected.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of mandatory protection under the law of the state of their habitual residence. If the buyer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Osnabrück. Should a provision be invalid, the rest remains valid.
